Privacy Policy
This Privacy Policy explains how The Picker’s Guide LLC (“Picker’s Guide,” “we,” “us,” or “our”) collects, uses, and shares information when you use pickersguide.com, our web application, any mobile applications, and related services (the “Service”). It is incorporated into our Terms of Service. By using the Service, you agree to this Policy. If you do not agree, do not use the Service.
1. Information We Collect
Information you provide directly
- Account information — your name, email address, and password when you register. (Passwords are stored only in hashed form.)
- Profile and preferences — display settings, instrument preferences, and other choices you save to your account.
- Payment information — when you subscribe, our payment processor (Stripe) collects and processes your payment-card details. We do not receive or store your full card number; we receive limited information such as a customer/subscription identifier, card brand and last four digits, billing status, and renewal dates.
- Content you upload or submit — audio files and recordings you upload, and songs, tunes, recordings, chord charts, lyrics, corrections, suggestions, playlists, and other materials you submit (“Your Content,” as defined in the Terms).
- Communications — messages you send us through our contact form, “report a mistake,” “suggest a song,” support requests, or email.
Information we collect automatically
- Usage and event data — pages and features you view and interact with, songs and tools you use, and in-product events we log (such as account, playback, and subscription-funnel events). This includes analytics collected through Jetpack Stats (provided by Automattic), which records page views, referring pages, and related visitor activity.
- Device and log data — IP address, browser type, device and operating-system information, referring pages, and timestamps, collected by us and by Jetpack/Automattic.
- Cookies and similar technologies — used to keep you logged in, remember preferences, secure the Service, and measure usage. See Section 4.
Information from third parties
- Payment and subscription status from Stripe.
- Limited technical information from our hosting, storage, and content-delivery providers in the ordinary course of operating the Service.
We do not intentionally collect sensitive personal information, and we ask that you not upload it.
2. How We Use Information
We use information to:
- create and manage your account and provide the Service;
- process payments, manage your Membership, and handle renewals, cancellations, and refunds;
- process and store the audio and content you upload, including generating practice audio, stems, waveforms, backing tracks, and related outputs you request;
- review, curate, publish, or decline content you submit to the catalog;
- operate, maintain, secure, debug, and improve the Service, and develop new features;
- analyze usage and measure the performance of features and our signup and Membership funnel;
- communicate with you about your account, transactions, support requests, updates, and — where permitted — news and offers (you can opt out of marketing email);
- detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms; and
- comply with legal obligations and enforce our agreements.
We do not sell your personal information, and we do not use the audio you privately upload to train or fine-tune AI/machine-learning models except to deliver the specific processing feature you requested or with your express permission.
3. How We Share Information
We share information only as follows:
- Service providers that process information on our behalf, under contracts that limit their use of it, including: Stripe (payments), Cloudflare (audio storage via R2 and content delivery), WordPress.com / Automattic (hosting and Jetpack analytics, which collects visitor and usage data on our behalf), and email providers.
- Third-party media platforms — when you play embedded or linked media (such as Spotify or YouTube), those platforms may collect information under their own privacy policies. We do not control them.
- Public content — content you submit for publication to the catalog, and information you choose to make public (such as a shared playlist link), may be visible to others.
- Legal and safety — when we believe disclosure is necessary to comply with law, legal process, or government request, or to protect the rights, safety, or property of Picker’s Guide, our users, or others.
- Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
4. Cookies and Tracking
We use cookies and similar technologies for authentication, security, remembering preferences, and analytics, including cookies set by Jetpack/Automattic for usage measurement. You can control cookies through your browser settings, but disabling some cookies may affect how the Service works. We honor Global Privacy Control (GPC) signals where required by law as a request to opt out of any “sale” or “sharing” of personal information (note: we do not sell personal information).
5. Data Retention
We retain personal information for as long as your account is active and as needed to provide the Service, then for a reasonable period afterward to comply with legal obligations, resolve disputes, enforce our agreements, and for backup and operational purposes. You can request deletion as described in Section 6. Some information may persist in backups for a limited time, and we may retain de-identified or aggregated data that no longer identifies you.
6. Your Rights and Choices
- Access and update — you can view and update most account information in your account settings.
- Cancel your Membership — at any time through your account settings or by emailing legal@pickersguide.com (see Terms §4.4–4.5).
- Delete your account — request deletion by emailing legal@pickersguide.com; we will delete or de-identify your personal information except where we are required or permitted to retain it.
- Marketing opt-out — unsubscribe via the link in our emails or by contacting us; we will still send essential account and transactional messages.
California residents (CCPA/CPRA): you have rights to know, access, correct, and delete personal information, and to opt out of “sale”/“sharing” and limit use of sensitive personal information. We do not sell your personal information. You may exercise these rights at legal@pickersguide.com, and we will not discriminate against you for doing so.
EEA/UK residents (GDPR): where applicable, you have rights to access, rectify, erase, restrict, and port your personal data and to object to processing. Our legal bases are: performance of our contract with you (providing the Service), your consent (e.g., marketing), our legitimate interests (e.g., security and improving the Service), and compliance with law. You may contact us at legal@pickersguide.com or lodge a complaint with your local supervisory authority.
To protect your account, we may need to verify your identity before acting on a request.
7. Security
We use reasonable administrative, technical, and physical safeguards to protect information, including encryption in transit, hashed passwords, and reliance on reputable processors such as Stripe and Cloudflare. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your password confidential.
8. Children’s Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has provided us information, contact legal@pickersguide.com and we will delete it. Users between 13 and 18 must have a parent’s or guardian’s consent (see Terms §1).
9. International Users
We are based in the United States, and the Service is operated from and stored in the United States. If you access the Service from outside the U.S., you understand that your information will be transferred to, processed, and stored in the U.S., where data-protection laws may differ from those in your country. Where required, we rely on appropriate safeguards for international transfers.
10. Third-Party Links and Services
The Service contains links to and embeds from third-party sites and services we do not control. This Policy does not apply to them; review their privacy policies separately.
11. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will provide reasonable notice (for example, by updating the “Last updated” date, posting a notice, or emailing you). Your continued use of the Service after changes take effect constitutes acceptance.
